Houston Accident

A wrecker driver responding to a call was involved in an accident that sent two men to the hospital, and Harris County Sheriff’s deputies are trying to determine who was at fault. A flatbed-wrecker driver was traveling eastbound on Fallbrook when the truck collided with a car traveling northbound on the Sam Houston Parkway feeder around midnight. The wrecker was hit on the side and knocked into a metal traffic-light pole. Heavy rescue had to free the two men trapped inside the car. One man was airlifted to Memorial Hermann Hospital in serious condition and the other was transported by ground ambulance in stable condition. The wrecker driver was not hurt. Deputies are trying to determine which driver ran the red light. Both drivers claimed their light was green.

Drunk Driving Accident

A Houston police officer was hospitalized after her squad car was hit by a 25-year-old drunk driver in east Houston Sunday night. Police said HPD Officer Vanessa Tewell was en route to a call around 8 p.m. She was pulling away from a stop sign when her squad car was struck by a red Honda Civic. Louis Antonio Banegas, who was driving the Civic, hopped out and attempted to flee on foot, but was quickly caught.

Officer Tewell was transported to Memorial Hermann Hospital in stable condition. She sustained several injuries, including a broken pelvis and a broken leg. Banegas was charged with felony intoxication assault on a peace officer.

Wrongful Death Lawsuit

A Houston millionaire has reportedly settled a wrongful-death lawsuit against him. John Goodman allegedly hit and killed a man while driving drunk in Florida two years ago, and he then adopted his 42-year-old girlfriend in an apparent attempt to protect his assets.

Sources say Goodman has now settled with the victim’s parents, but the amount of money is being kept secret. Goodman still faces DUI manslaughter charges and his trial starts Tuesday.

Sexual Harassment

Eight current and former members of the U.S. military allege in a new federal lawsuit that they were raped, assaulted or harassed during their service and suffered retaliation when they reported it to their superiors. The lawsuit, being filed Tuesday in U.S. District Court in Washington, accuses the military of a having a “high tolerance for sexual predators in their ranks” and of fostering a hostile environment that discourages victims of sexual assault from coming forward and punishes them when they do. The suit says the Defense Department has failed to take aggressive steps to confront the problem despite public statements suggesting otherwise.

The women say they’ve suffered depression, anxiety and post-traumatic stress disorder because of the assaults. One woman says she tried to commit suicide after being raped inside her row home by a senior officer and his civilian friend.

Wrongful Death Lawsuit

In July of 2011, the family of a 25 year old night time shift manager at Pilgrim’s Pride pursued a wrongful death lawsuit. The lawsuit claimed that the young man was pinned beneath a truck’s tires as the truck was backing up into a bay. The 25 year old was apparently wearing the appropriate attire, including a bright orange vest to increase visibility. He was rushed to the hospital, where he was pronounced dead. The lawsuit is against all responsible parties.

Employment Class Action

An employment class action lawsuit has been filed in San Francisco Superior Court against the California-based retailer, Forever 21. The lawsuit alleges Forever 21 required its employees to perform work without compensation and denied them meal breaks.

The lead plaintiffs, Jazzreeal Jones, Jessica Ramos, Shanelle Thompson, Alyssa Elias and Tiffinee Linthicum, say the company routinely detained them and their co-workers inside Forever 21 stores on lunch breaks and after their shifts were over so managers could search them for company merchandise. The suit alleges these delays resulted in substantial unpaid labor every day for thousands of Forever 21 employees in California. The workers’ lawyers are also asking the State of California to appoint them as private attorneys general so they may prosecute penalty claims on behalf of the State.

This is not the first time Forever 21 has come under criticism for its employment practices. In 2001, workers from six factories sued the company and called for a boycott of Forever 21 products for what they called “unsafe and unsanitary working conditions.” That lawsuit was dropped after Forever 21 agreed to change its labor practices in its factories and pay the workers the wages they had earned.
